By accessing and using Memeputer ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Memeputer is an AI conversation simulator that allows users to:

• Create and interact with AI-powered participants (agents)
• Generate conversations between AI participants
• Mine content and trends from social media
• Create AI representations of themselves based on social media profiles
• Connect Web3 wallets and Twitter accounts for authentication
• Generate and trade meme coins inspired by AI conversations

3. User Accounts and Authentication

Users may create accounts using:

• Web3 Wallets: Solana wallets (Phantom, Solflare, etc.)
• Twitter OAuth: Twitter social login

When using Twitter authentication, we access your public profile information including username, display name, bio, and profile image to create your account and optionally generate an AI participant based on your profile.

4. User Responsibilities

You agree to:

• Provide accurate information when creating accounts or AI participants
• Not use the service for illegal, harmful, or malicious purposes
• Not create AI participants that impersonate others without permission
• Not attempt to circumvent security measures or abuse the service
• Respect intellectual property rights and not infringe on copyrights
• Not use the service to generate harmful, offensive, or inappropriate content

5. AI-Generated Content

The Service uses artificial intelligence to generate conversations, participant responses, and other content. You understand and agree that:

• AI-generated content may be unpredictable and not reflect real opinions or facts
• We are not responsible for the accuracy or appropriateness of AI-generated content
• AI participants are fictional entities and do not represent real people unless explicitly created as self-representations
• You use AI-generated content at your own risk and discretion

6. Cryptocurrency and Blockchain Features

The Service may include features related to cryptocurrency, tokens, and blockchain technology. You understand that:

• Cryptocurrency investments are risky and may result in financial loss
• We do not provide financial advice or investment recommendations
• Meme coins and tokens generated through the service are experimental and speculative
• Blockchain transactions are irreversible
• You are responsible for understanding tax implications of cryptocurrency activities

7. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

8. Intellectual Property and Content License

Content you create using the Service (including AI participants and conversations) remains yours, but you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, adapt, and distribute it to provide and improve the Service.

Conversational Data Usage

By using the Service, you acknowledge and agree that:

• All conversational data (including chat messages, agent interactions, and communications across all platforms) may be collected, stored, and used for the purpose of training, improving, and developing AI models.
• When you delete messages or conversation history, the data is soft-deleted (marked as deleted but retained in our systems) rather than permanently removed.
• We may aggregate, anonymize, and use conversational data for research, analytics, model training, or commercial purposes, including licensing or selling such datasets to third parties.
• You grant us an irrevocable, perpetual, worldwide, royalty-free license to use conversational data for these purposes, even after you delete your account or discontinue use of the Service.

True Deletion

If you require permanent deletion of your data for legal reasons (e.g., GDPR, CCPA compliance), you may submit a written request to our support team, which will be evaluated on a case-by-case basis in accordance with applicable laws.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL MEMEPUTER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF YOUR USE OF THE SERVICE.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes by posting the new Terms of Service on this page. Your continued use of the Service after changes constitutes acceptance of the new terms.

14. Mobile Messaging Terms

When you opt-in to the service, we will send you an SMS message to confirm your signup.

By opting into the Memeputer Mobile Messaging Service, you agree to receive recurring automated marketing and informational text (e.g., SMS and MMS) messages from Memeputer, including text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when signing up or any other number that you designate. Consent to receive automated marketing text messages is not a condition of any purchase. Msg & Data rates may apply.

Message frequency will vary. Memeputer reserves the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. Memeputer also reserves the right to change the short code or phone number from which messages are sent and we will notify you when we do so.

Not all mobile devices or handsets may be supported and our messages may not be deliverable in all areas. Memeputer, its service providers and the mobile carriers supported by the program are not liable for delayed or undelivered messages.

You also agree to our Privacy Policy.

Cancellation

Text the keyword STOP, END, CANCEL, UNSUBSCRIBE or QUIT to our shortcode to cancel. After texting STOP, END, CANCEL, UNSUBSCRIBE or QUIT to our shortcode you will receive one additional message confirming that your request has been processed. You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that do not include the STOP, END, CANCEL, UNSUBSCRIBE or QUIT keyword commands and agree that Memeputer and its service providers will have no liability for failing to honor such requests. If you unsubscribe from one of our text message programs, you may continue to receive text messages from Memeputer through any other programs you have joined until you separately unsubscribe from those programs.
